If you are a parent or legal guardian creating an Account, making a purchase, or arranging Services for a minor, you agree to these Terms on your own behalf and on behalf of the minor, as applicable.

If you do not agree to these Terms, please do not use the Website or purchase or use Our products or Services.

Certain products or Services may be subject to additional terms, policies, descriptions, or requirements presented at the time of purchase, enrollment, or booking. Those additional terms are incorporated into these Terms where applicable.

2. Age Restrictions

2.1 Our educational Services may be used by children and teenagers. Users under the age of 18 should use Our Website and Services with the involvement and authorization of a parent or legal guardian.

2.2 Children under the age of 13 may not independently create an Account or provide Personal Data through Our Website. A parent or legal guardian must create or manage the Account and authorize the child's participation in Our Services, as described in Our Privacy Policy.

2.3 Purchases, paid enrollments, and paid tutoring arrangements for a minor must be made or authorized by a parent or legal guardian. The parent or legal guardian is responsible for the purchase and for ensuring that the minor's use of the Services complies with these Terms.

2.4 By creating an Account, making a purchase, or arranging Services for a minor, the parent or legal guardian represents that they are authorized to do so and agrees to these Terms as applicable to their own and the minor's use of the Services.

3. Business Customers

These Terms also apply to businesses, schools, educational organizations, and other entities that purchase or use Our Services, unless a separate written agreement between My Math Mindset LLC and the organization states otherwise.

If you purchase or use Our Services on behalf of an organization, you represent that you have authority to agree to these Terms on behalf of that organization.

4. Intellectual Property

4.1 Ownership: Unless otherwise stated, the Website and Content created by My Math Mindset LLC, including but not limited to text, graphics, logos, images, videos, lessons, instructional materials, guided notes, practice materials, assessments, downloadable resources, course organization, and other educational materials, are owned by or licensed to My Math Mindset LLC and are protected by applicable United States and international intellectual property laws.

Content owned by third parties remains the property of its respective owners and is used or made available subject to applicable licenses, permissions, or terms.

4.2 Limited License for Personal Educational Use: When you purchase or receive access to Our Content, Digital Products, or Services, We grant you a limited, non-exclusive, non-transferable license to use the materials for the personal educational use of the Student or User for whom they were purchased or provided.

Unless otherwise stated, downloadable or printable materials may be downloaded and printed for that Student's personal educational use.

4.3 Prohibited Uses: Unless We provide express written permission, you may not:

  • Copy, reproduce, republish, distribute, sell, sublicense, or commercially exploit Our Content;
  • Share purchased or restricted Content with individuals who have not been granted access;
  • Share Account login credentials for the purpose of allowing another person to access paid Content;
  • Upload, post, distribute, or make Our Content available through websites, shared drives, social media, file-sharing services, course-sharing platforms, or other public or private distribution systems;
  • Record, download, reproduce, or redistribute course videos except where a download is expressly provided by Us;
  • Remove or alter copyright notices, branding, watermarks, or other ownership notices from Our Content; or
  • Use Our Content to create, reproduce, or distribute substantially similar materials for commercial purposes.

4.4 School, Classroom, and Organizational Use
Purchase of Content or Services for an individual does not automatically grant permission for classroom-wide, school-wide, tutoring-center, or organizational use. Additional licenses or written permission may be required for use with multiple students or Users.

Where We offer a separate classroom, school, or organizational license, use of the applicable Content will be subject to the terms of that license or agreement.

4.5 No Transfer of Ownership
Purchasing or accessing Our Content, Digital Products, or Services does not transfer ownership of any intellectual property rights to you. All rights not expressly granted under these Terms are reserved by My Math Mindset LLC and the applicable third-party rights holders.

5. Fair Use of Intellectual Property

Nothing in these Terms is intended to restrict any use of copyrighted material that is permitted under applicable law, including fair use under United States copyright law.

Any use of Our Content beyond the personal educational use expressly permitted under these Terms must either be permitted by applicable law or authorized by Us in writing.

We reserve the right to restrict, suspend, or terminate access to the Website or Services when We reasonably believe a User has violated these Terms, engaged in unlawful or harmful conduct, or created a security or safety risk

8. Accounts

8.1 Account Creation
Certain Services may require an Account. When creating or managing an Account, you agree to provide accurate and current information and to update that information when reasonably necessary.

Accounts for children under 13 must be created or managed by a parent or legal guardian in accordance with the Age Requirements and Minors section of these Terms and Our Privacy Policy.

8.2 Account and Payment Information

Depending on the Services you use, you may be asked to provide contact, account, billing, or payment information. Payment information may be processed and securely stored by Our third-party payment processor to complete purchases or, with your authorization, maintain a payment method for future charges.

My Math Mindset LLC does not directly store complete credit or debit card numbers. Payment processing and storage of payment credentials are handled by the applicable third-party payment processor.

Additional terms regarding payments, saved payment methods, and authorization for tutoring charges are provided in the Payments and Billing section of these Terms.

8.3 Account Security
You are responsible for maintaining the confidentiality of your Account login credentials and for activity occurring through your Account. You should not share your username, password, or other login credentials with individuals who are not authorized to use the Account.

If you believe that your Account has been accessed without authorization or that your login credentials have been compromised, please contact Us promptly at cathie@mymathmindset.com.

8.4 Individual Account Access
Unless otherwise expressly permitted by Us, an Account and any associated course enrollment or purchased Content are intended for the individual Student or User for whom access was purchased or provided.

Account credentials may not be shared for the purpose of allowing additional individuals to access paid courses, Content, Digital Products, or other restricted Services without purchasing or receiving appropriate access.

A parent or legal guardian may assist with or manage an Account used by their minor child.

8.5 Suspension or Termination
We may restrict, suspend, or terminate an Account if We reasonably believe that the Account is being used in violation of these Terms, including unauthorized sharing of Account credentials or Content, fraudulent activity, unlawful conduct, or activity that creates a security or safety risk.

Where reasonably practicable, We will provide notice of an Account restriction, suspension, or termination.

9. Termination and Cancellation of Accounts

9.1 Termination by You 
You may request closure of your Account by contacting Us at cathie@mymathmindset.com. Closing an Account does not automatically cancel or refund purchases already completed, Services already provided, or amounts properly owed under these Terms.

9.2 Termination or Suspension by Us
We may suspend or terminate an Account if We reasonably believe that a User has violated these Terms, engaged in fraudulent, unlawful, abusive, or harmful conduct, shared Account access or paid Content without authorization, failed to pay amounts due, or created a security or safety risk.

We may also discontinue an Account or Service for legitimate business or operational reasons. Where reasonably practicable, We will provide notice of the suspension or termination.

9.3 Effect of Termination
Upon termination of an Account, the User's right to access the Account and any Content or Services requiring that Account may end.

Termination does not eliminate payment obligations for Services already provided or other amounts properly incurred before termination. Any refund that may be available will be determined according to the applicable refund, cancellation, or purchase terms.

Provisions of these Terms that by their nature should continue after termination, including provisions relating to intellectual property, payment obligations, limitations of liability, and dispute resolution, will remain in effect.

10. Services, Pricing and Availability

10.1 Service Descriptions
We make reasonable efforts to accurately describe the Services, courses, Digital Products, and other offerings available through Our Website. Specific features, materials, schedules, instructors, course content, or other details may vary where reasonably necessary.

For personalized Services such as tutoring, the specific instruction provided may vary based on the Student's individual needs, goals, progress, and circumstances.

10.2 Availability
Our Services are subject to availability. Tutoring appointments may be limited based on scheduling availability, location, and capacity. Courses, Digital Products, or other Services may be added, modified, temporarily unavailable, or discontinued from time to time.

We do not guarantee that any particular Service, course, resource, appointment time, or offering will remain available indefinitely.

10.3 Pricing
Current prices for Services available for purchase through Our Website will be displayed at the time of purchase or otherwise communicated to you before you agree to purchase the applicable Service.

We may change Our prices, fees, packages, or promotional offers from time to time. Unless otherwise stated, a price change will not affect a purchase that has already been completed.

10.4 Ongoing Tutoring Rates
If We change the rate charged for ongoing tutoring Services, We will provide reasonable advance notice before the new rate applies. The new rate will apply only to tutoring Services provided after the effective date of the rate change.

10.5 Errors in Pricing or Service Information
We make reasonable efforts to ensure that pricing and Service information is accurate. If We discover a material error in the price or description of a Service before it is provided, We may contact you to correct the error and, where appropriate, give you the option to proceed under the corrected terms or cancel the affected purchase or Service.

11. Orders and Provision of Services

11.1 Purchases of Courses and Digital Products
When you purchase a course, Digital Product, or other educational product through Our Website, you agree to pay the price displayed at the time of purchase, together with any applicable taxes or fees disclosed before completing the transaction.

After successful payment, you will receive access to the purchased course, Digital Product, or other Content according to the access terms stated at the time of purchase. Access may be provided through your Account, electronically, by download, or through another method described with the applicable product.

Receipt of an order or payment confirmation does not prevent Us from canceling and refunding a transaction if We are unable to provide the purchased product or Service, if a material pricing or technical error occurred, or if We reasonably believe the transaction is fraudulent or unauthorized.

11.2 Tutoring Services
Tutoring Services are provided according to appointments scheduled or otherwise agreed upon between you and My Math Mindset LLC. Scheduling an appointment reserves the applicable appointment time but does not guarantee any particular educational result or outcome.

Tutoring fees, session length, location or method of delivery, and other applicable details will be disclosed through the scheduling process or otherwise communicated before the Service is provided.

Where a payment method is maintained on file for tutoring Services, charges will be processed according to the Payments and Billing section of these Terms.

11.3 Service Delivery
We will make reasonable efforts to provide purchased Services and Content as described at the time of purchase, enrollment, or booking.

Digital access may be provided immediately or within a reasonable period after successful payment or enrollment. Tutoring Services will be provided at the scheduled appointment time, subject to the applicable cancellation and rescheduling policy.

If a technical or administrative error prevents access to a purchased course, Digital Product, or other Service, please contact Us at cathie@mymathmindset.com so that We can make reasonable efforts to correct the issue.

11.4 Additional Terms
Certain Services, courses, Digital Products, tutoring arrangements, promotions, or other offerings may include additional terms, requirements, access periods, or policies disclosed at the time of purchase, enrollment, or booking. Those additional terms will apply to the applicable purchase or Service.

12. Payments & Billing

12.1 Payment Processing
Payments for Our Services, courses, and Digital Products may be processed through third-party payment processors. By providing a payment method, you represent that you are authorized to use that payment method and authorize the applicable charges described at the time of purchase, booking, or arrangement of Services.

Payment information may be securely stored by Our third-party payment processor when you choose or authorize a payment method to be kept on file. My Math Mindset LLC does not directly store complete credit or debit card numbers.

12.2 Course and Digital Product Purchases
Courses, Digital Products, and other products purchased through Our Website will generally be charged at the time of purchase unless otherwise stated.

You authorize Us and Our payment processor to charge the payment method you provide for the purchase price and any applicable taxes or fees disclosed before you complete the transaction.

12.3 Tutoring Payment Method On File
For ongoing or individually scheduled tutoring Services, We may require or allow a parent, legal guardian, or other responsible customer to maintain an authorized payment method on file with Our payment processor.

By providing and authorizing a payment method for tutoring Services, you authorize My Math Mindset LLC, through Our payment processor, to charge that payment method for tutoring Services provided to the Student at the rate communicated to you before the applicable Service is provided.

Unless otherwise stated, tutoring Services may be charged after the applicable tutoring session has been completed.

12.4 Cancellation and Missed-Appointment Charges
If a tutoring appointment is canceled late or missed and a fee applies under the cancellation policy disclosed at the time of booking, you authorize Us to charge the authorized payment method on file for the applicable fee.

Cancellation and rescheduling terms are described in the Cancellations and Refunds section of these Terms and may also be disclosed during the scheduling process.

12.5 Payment Receipts and Records
Receipts, invoices, or other payment confirmations may be provided electronically through Our Website, payment processor, scheduling system, or by email. You are responsible for reviewing payment confirmations and contacting Us promptly at cathie@mymathmindset.com if you believe a charge was made in error.

12.6 Failed or Declined Payments
If a payment is declined, fails, or cannot be processed, We may request an alternative payment method or retry the authorized payment method where permitted.

We may suspend access to paid Services or decline to provide additional paid Services while an outstanding balance remains unpaid.

12.7 Payment Method Changes and Withdrawal or Authorization
You may update your payment method or withdraw authorization for future charges by contacting Us or updating your payment information through the applicable payment or account system where available.

Withdrawal of authorization for future charges does not eliminate responsibility for amounts already owed for Services previously provided or charges properly incurred before the authorization was withdrawn.

13. Cancellation of Orders and Services

Cancellation and refund terms vary depending on the type of Service or product purchased. Any additional cancellation or refund terms disclosed at the time of purchase, enrollment, or booking will also apply.

13.1 Tutoring Appointments
We understand that schedules change. Tutoring appointments may be canceled or rescheduled according to the cancellation policy provided at the time of booking.

If an appointment is canceled or rescheduled within the permitted cancellation period, no cancellation fee will be charged.

Late cancellations and missed appointments may be charged according to the cancellation policy disclosed at the time of booking. If you have authorized a payment method to be kept on file, you authorize Us to charge that payment method for any applicable late-cancellation or missed-appointment fee.

If My Math Mindset LLC must cancel a tutoring appointment, you will not be charged for that appointment. If a payment has already been processed, the applicable amount will be refunded or credited.

13.2 Online Courses
Refund eligibility for online courses will be determined by the refund policy disclosed at the time of purchase. Unless otherwise stated, access to a course begins when enrollment or course access is provided.

Any refund request must be submitted to cathie@mymathmindset.com within the applicable refund period. We reserve the right to consider course access, completion, downloads, or other use of course materials when determining refund eligibility where permitted by applicable law and the terms disclosed at purchase.

13.3 Digital Products and Downloadable Resources
Because Digital Products and downloadable resources may be accessed or downloaded immediately after purchase, purchases of these products are generally final and non-refundable once access or download has been provided, except where required by law or where the product is defective, inaccessible, or materially different from its description.

If you experience a technical problem accessing a purchased Digital Product, please contact Us at cathie@mymathmindset.com so that We can make reasonable efforts to resolve the issue.

13.4 Refund Processing
Approved refunds will generally be issued to the original payment method. Processing times may vary depending on the payment processor and financial institution.

Nothing in these Terms is intended to limit any refund, cancellation, or other consumer right that cannot legally be waived under applicable law.

My Math Mindset LLC provides educational instruction, tutoring, courses, resources, and related educational Services designed to support student learning and understanding. Individual results vary based on many factors, including Student participation, effort, attendance, prior knowledge, completion of assigned work, and other circumstances outside Our control.

We do not guarantee any particular grade, test score, academic placement, course outcome, improvement level, or other specific educational result from the use of Our Services.

15.2 Curriculum and School Requirements
Our courses, resources, and tutoring Services may supplement or align with particular academic subjects, standards, textbooks, or curricula. Unless expressly stated otherwise, My Math Mindset LLC is not affiliated with, endorsed by, or sponsored by any school, school district, textbook publisher, curriculum provider, testing organization, or other third party referenced in Our Content.

Students and families remain responsible for confirming requirements, assignments, grading policies, curriculum expectations, and other information provided by their school or educational institution.
15.3 Website and Digital Services
We make reasonable efforts to provide accurate, useful, and reliable Content and to maintain the availability and functionality of Our Website and digital Services. However, We do not guarantee that the Website or Services will always be uninterrupted, error-free, compatible with every device or system, or free from technical issues.

We may correct errors, update Content, or make reasonable changes to the Website and Services from time to time.

Your continued use of Our Website or Services after an updated version of these Terms becomes effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

Temporary interruptions or routine maintenance do not automatically entitle a User to a refund. Any refund or credit will be determined in accordance with the applicable purchase and refund terms and applicable law.

18. Limitation of Liability

18.1 Limitation of Certain Damages
To the maximum extent permitted by applicable law, My Math Mindset LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of, or inability to use, Our Website, Content, or Services.

18.2 Educational Outcomes
My Math Mindset LLC is not liable for a Student's grades, test scores, academic placement, school performance, or other educational outcomes. Our Services are intended to provide educational instruction and support, but individual results depend on many factors outside Our control.

18.3 Third-Party Services and Technology
To the maximum extent permitted by applicable law, We are not responsible for losses or damages resulting from the acts, omissions, interruptions, errors, or failures of third-party websites, platforms, payment processors, scheduling services, internet providers, or other third-party services outside Our reasonable control.

18.4 Maximum Liability
To the maximum extent permitted by applicable law, Our total liability for any claim arising out of or relating to a particular purchased product or Service will not exceed the amount you paid to My Math Mindset LLC for the product or Service giving rise to the claim.

Opting out of marketing communications will not prevent Us from sending non-promotional communications that are necessary to provide Services you have requested or purchased.
